Auto Insurance and TBI

Since so many brain injuries result from vehicular accidents, auto (and motorcycle) insurance is an important source of funding for medical and rehab services. Until a week ago, it never occurred to me to suspect that this could present problems – and then I read Jay M. Feinman’ s Delay, Deny, Defend (Why insurance companies don’t pay claims and what you can do about it). I suggest that anyone who is in a vehicular accident read this book (get your library or bookstore to order it, as it is a new book), especially the very clear suggestions about dealing with insurance companies (pp. 194-201), why your insurance company doesn’t want you to hire an attorney (pp. 86-103), medical claims (pp. 104-120). At a recent conference our Chaplain Alissa attended, she learned that litigation can have a negative effect on recovery for TBI survivors. However, the survivor may desperately need the funds from auto insurance to finance recovery, so the stress of a court case may be unavoidable. Everything I hear and read  says that your best bet is a lawyer who is used to dealing with insurance companies and understands about TBI.
